Que un conductor de Uber tenga un contrato laboral con Uber puede depender de si el conductor act\u00faa como empresario en el ejercicio de su actividad. Esto puede incluir circunstancias ajenas a la relaci\u00f3n entre el conductor y Uber. As\u00ed lo dictamin\u00f3 el Tribunal Supremo el 21 de febrero de 2025.<\/p>\n<p><!--more--><\/p>\n<p><strong>El caso<br \/><\/strong>Los conductores que prestan servicios de transporte en taxi a trav\u00e9s de la aplicaci\u00f3n Uber en virtud de un acuerdo con Uber lo hacen como contratistas independientes, no como empleados de Uber, seg\u00fan las condiciones de Uber. El sindicato FNV considera que existen contratos de trabajo entre Uber y los conductores. FNV reclam\u00f3 que el tribunal declarara que el CAO Transporte de Taxis se aplica a los conductores y que se ordenara a Uber cumplir plenamente este CAO. El tribunal accedi\u00f3 a estas demandas. En apelaci\u00f3n, el Tribunal de Apelaci\u00f3n remiti\u00f3 las cuestiones al Tribunal Supremo.<\/p>\n<p><strong>Las preguntas<br \/><\/strong>Las preguntas se refieren a c\u00f3mo debe entenderse la sentencia del Tribunal Supremo sobre Deliveroo. La sentencia Deliveroo se refer\u00eda a si los repartidores de Deliveroo trabajan sobre la base de un contrato de trabajo. Seg\u00fan la sentencia Deliveroo, la existencia de un contrato de trabajo depende de todas las circunstancias del caso. En la sentencia Deliveroo, el Tribunal Supremo menciona una serie de circunstancias espec\u00edficas que pueden ser relevantes. Entre otras cosas, puede ser importante si la persona que realiza el trabajo se comporta o puede comportarse como empresario (\"entrepreneurship\") en la vida econ\u00f3mica.<\/p>\n<p>La primera cuesti\u00f3n es si la \"iniciativa empresarial\" del trabajador puede ser decisiva para determinar si existe o no un contrato de trabajo.<\/p>\n<p>La segunda cuesti\u00f3n es si una respuesta afirmativa a la primera cuesti\u00f3n significa que la relaci\u00f3n laboral de un trabajador sin \"esp\u00edritu empresarial\" es un contrato de trabajo, mientras que la relaci\u00f3n laboral de otro trabajador, con \"esp\u00edritu empresarial\", no es un contrato de trabajo, aunque realicen el mismo trabajo para el mismo cliente.<\/p>\n<p>La tercera cuesti\u00f3n es si el \"esp\u00edritu empresarial\" mencionado en la sentencia Deliveroo se limita a los aspectos que se producen en la relaci\u00f3n laboral entre el trabajador y el cliente, o si tambi\u00e9n son relevantes aspectos ajenos a esa relaci\u00f3n laboral concreta.<\/p>\n<p><strong>Sentencia del Tribunal Supremo<br \/><\/strong>El Tribunal Supremo respondi\u00f3 a las preguntas de la siguiente manera.<\/p>\n<p>En la sentencia Deliveroo, el Tribunal Supremo no jerarquiz\u00f3 las circunstancias relevantes para apreciar la existencia de un contrato de trabajo. As\u00ed, la circunstancia de la \"iniciativa empresarial\" no es menos importante que las dem\u00e1s circunstancias. El Tribunal Supremo tampoco ve ahora raz\u00f3n alguna para tal orden de prelaci\u00f3n. No puede descartarse que, para responder a la pregunta de si un contrato es laboral, sea decisivo que el trabajador act\u00fae o pueda actuar como empresario en el marco de la actividad empresarial, aunque otras circunstancias apunten a la existencia de un contrato de trabajo.<\/p>\n<p>Por tanto, puede darse el caso de que la relaci\u00f3n laboral respecto del mismo trabajo, realizado para el mismo cliente, no sea un contrato de trabajo para un trabajador con \"esp\u00edritu empresarial\" y s\u00ed lo sea para un trabajador sin \"esp\u00edritu empresarial\".<\/p>\n<p>La \"iniciativa empresarial\" en el sentido de la sentencia Deliveroo se refiere a la situaci\u00f3n general (empresarial) del trabajador y, por tanto, tambi\u00e9n puede abarcar circunstancias ajenas a la relaci\u00f3n espec\u00edfica entre el trabajador y su cliente.<\/p>\n<p><strong>Nota: <\/strong>Para muchos aut\u00f3nomos y sus clientes, esta decisi\u00f3n puede ser de gran importancia.
