Rescinde su contrato de trabajo para incorporarse a un competidor potencial. Su antiguo jefe ya trabaja all\u00ed. Le env\u00eda un archivo con las ventas mensuales de cada tienda. Esto sale a la luz por accidente y se produce el despido inmediato.<\/p>\n<p><!--more--><\/p>\n<p><strong>\u00bfC\u00f3mo sale a la luz el correo?<br \/><\/strong>Durante una conversaci\u00f3n previa a la contrataci\u00f3n con el posible empleador, se habl\u00f3 de robar informaci\u00f3n. Una investigaci\u00f3n comprob\u00f3 el buz\u00f3n profesional del directivo y revel\u00f3 el correo electr\u00f3nico enviado con el expediente de rotaci\u00f3n.<\/p>\n<p><strong>Consideraciones sobre los tribunales de distrito<\/strong><br \/>El tribunal de distrito consider\u00f3 que, al enviar el correo electr\u00f3nico, el directivo hab\u00eda incumplido la cl\u00e1usula de confidencialidad. El correo electr\u00f3nico conten\u00eda informaci\u00f3n confidencial y sensible desde el punto de vista empresarial de la que tuvo conocimiento en el ejercicio de sus funciones. Al enviar el correo electr\u00f3nico, esos datos llegaron a manos de un tercero. El env\u00edo de tales datos a un tercero constituye un motivo urgente de despido.<\/p>\n<p>Es evidente que dicha informaci\u00f3n deber\u00eda haber permanecido en el \u00e1mbito empresarial y familiar del empresario. Tambi\u00e9n es un factor aqu\u00ed que el empleador tenga una pol\u00edtica clara cuando se trata de proteger su informaci\u00f3n confidencial y de secreto comercial, como se describe en un C\u00f3digo de \u00c9tica.<\/p>\n<p>El tribunal de distrito no considera que el hecho de que el gerente pudiera haber enviado estos datos por correo electr\u00f3nico por error, como argument\u00f3, sea significativo de la existencia de un motivo urgente. Al fin y al cabo, un despido sumario no requiere intencionalidad ni culpabilidad. Por tanto, un error por descuido tambi\u00e9n puede constituir un motivo urgente. Adem\u00e1s, el tribunal de distrito no consider\u00f3 plausible que el directivo en este caso enviara los datos por error.<\/p>\n<p>El hecho de que el antiguo directivo borrara r\u00e1pidamente los datos recibidos y no se siguieran difundiendo en la otra empresa no altera el hecho de que estos datos se tomaron fuera del entorno empresarial del empresario y esta acci\u00f3n del directivo puede ser muy reprochada por el empresario.<\/p>\n<p>Adem\u00e1s, para el tribunal de distrito, responder a la pregunta de si la otra empresa debe o no considerarse competidora es irrelevante. Lo que importa es que, al enviar su correo electr\u00f3nico, el directivo revel\u00f3 informaci\u00f3n confidencial y sensible para la empresa, y ese solo hecho lo convierte en un motivo urgente.<\/p>\n<p><strong>Conclusi\u00f3n tribunal de distrito<\/strong><em><br \/><\/em>El tribunal de distrito consider\u00f3 que el despido en cuesti\u00f3n era jur\u00eddicamente v\u00e1lido. La conducta del gerente no s\u00f3lo constituye un motivo de urgencia, sino que adem\u00e1s es gravemente culpable. Por lo tanto, no procede ninguna indemnizaci\u00f3n transitoria.
