Seg\u00fan el fot\u00f3grafo, ten\u00eda un contrato de trabajo de siete meses. A pesar de los requerimientos previos, s\u00f3lo se le pagaron dos meses. Seg\u00fan el empresario, abandon\u00f3 su empleo a los dos meses y se fue a trabajar a otro lugar. \u00bfC\u00f3mo se pronuncia el juez en un procedimiento sumario?<\/p>\n<p><!--more--><\/p>\n<p><strong>Litigio y resultado<\/strong><br \/>En el centro del litigio est\u00e1 la cuesti\u00f3n de si el empresario debe pagar al fot\u00f3grafo los salarios atrasados y la paga de vacaciones reclamados. El tribunal de distrito consider\u00f3 veros\u00edmil que la demanda fuera estimada en un procedimiento ordinario, por lo que estim\u00f3 la demanda. A continuaci\u00f3n se explica c\u00f3mo lleg\u00f3 el tribunal de distrito a esta sentencia.<\/p>\n<p><strong>Consideraciones del juez<\/strong><br \/>No se discute que el fot\u00f3grafo se incorpor\u00f3 a la empresa en virtud de un contrato de trabajo celebrado con \u00e9sta. Tambi\u00e9n ha quedado acreditado que el fot\u00f3grafo comenz\u00f3 a cumplir el contrato de trabajo realizando el trabajo a partir de ese momento.<\/p>\n<p>Seg\u00fan el empleador, el fot\u00f3grafo dej\u00f3 su empleo al cabo de dos meses y se fue a trabajar a otra empresa, pero el fot\u00f3grafo rebati\u00f3 esta afirmaci\u00f3n con razones. Posteriormente, el empleador no justific\u00f3 m\u00e1s esta afirmaci\u00f3n. Por ejemplo, el empresario no present\u00f3 ning\u00fan documento del que se dedujera que el fot\u00f3grafo hab\u00eda dejado su empleo. Adem\u00e1s, el fot\u00f3grafo ha mostrado las n\u00f3minas de los meses posteriores al empleador.<\/p>\n<p>En este contexto, el hecho de que el fot\u00f3grafo firmara unos meses m\u00e1s tarde un contrato de trabajo en el que se estipulaba que entrar\u00eda al servicio de la otra empresa con car\u00e1cter retroactivo no da lugar a una sentencia diferente, ya que ello no significa autom\u00e1ticamente que dejara de estar al servicio del empresario a partir de esa fecha. Adem\u00e1s, es plausible que el fot\u00f3grafo firmara este acuerdo s\u00f3lo porque le prometieron que la otra empresa le pagar\u00eda entonces su salario atrasado. No hay pruebas de que este acuerdo laboral se cumpliera en modo alguno.<\/p>\n<p><strong>Sentencia del juez<\/strong><br \/>En vista de lo anterior, el tribunal de distrito consider\u00f3 suficientemente veros\u00edmil que el fot\u00f3grafo siguiera empleado hasta la finalizaci\u00f3n del contrato. El empresario a\u00fan debe abonar el salario correspondiente al periodo restante. Adem\u00e1s, la paga de vacaciones debe abonarse durante el periodo total.  El pago del salario es una de las principales obligaciones de un empresario hacia un empleado. A falta de motivos para el retraso en el pago del salario en este caso, el tribunal de subdistrito concedi\u00f3 el aumento legal reclamado por el fot\u00f3grafo sobre el salario atrasado. El aumento legal asciende a 50%.<\/p>\n<p><strong>Nota:<\/strong> Al parecer, la decepci\u00f3n por la inminente marcha del fot\u00f3grafo llev\u00f3 al empresario a dejar de pagarle el sueldo. Puede que hubiera algo m\u00e1s.
