La v\u00eda del juzgado de primera instancia o del UWV hace tiempo que dej\u00f3 de ser la m\u00e1s seguida. Un despido de mutuo acuerdo le ofrece una soluci\u00f3n m\u00e1s r\u00e1pida y (a menudo m\u00e1s barata) que un procedimiento. Un procedimiento de mutuo acuerdo no s\u00f3lo ofrece una soluci\u00f3n en caso de conflicto laboral o despido econ\u00f3mico (parcial), sino tambi\u00e9n despu\u00e9s de que un trabajador lleve dos a\u00f1os incapacitado para el trabajo.<\/p>\n<\/div><h1  class=\"h-custom-headline h5\" style=\"color: #006e78;margin-top:30px;  margin-bottom:0px;\"><span>Flexibilidad y acuerdos claros\u00a0<\/span><\/h1><div id=\"\" class=\"x-text\" style=\"margin-top:0px;\" ><p>Se llega a un acuerdo final de mutuo acuerdo sobre los t\u00e9rminos de la rescisi\u00f3n del contrato de trabajo. En el caso de un trabajador por cuenta ajena, las cuestiones incluir\u00e1n:<\/p>\n<ul>\n<li>A qu\u00e9 indemnizaci\u00f3n por despido (transitievergoeding) tiene derecho;<\/li>\n<li>Qu\u00e9 vacaciones pagar\u00e1;<\/li>\n<li>Si la cl\u00e1usula de no competencia permanece intacta; y<\/li>\n<li>Si debe seguir trabajando hasta el final de la relaci\u00f3n laboral o ser dado de alta.<\/li>\n<\/ul>\n<p>Todos estos aspectos ofrecen a ambas partes la oportunidad de llegar a acuerdos a medida que se adapten a su situaci\u00f3n y necesidades espec\u00edficas.<\/p>\n<\/div><h1  class=\"h-custom-headline h5\" style=\"color: #006e78;margin-top:30px;  margin-bottom:0px;\"><span>El plazo (te\u00f3rico) de preaviso\u00a0<\/span><\/h1><div id=\"\" class=\"x-text\" style=\"margin-top:0px;\" ><p>Para un trabajador por cuenta ajena, ser\u00e1 importante asegurarse el subsidio de desempleo. Por tanto, en el acuerdo deber\u00e1 constar que usted, como empresario, tomar\u00e1 la iniciativa del despido y que, adem\u00e1s, no existe ning\u00fan motivo urgente para el despido. En cualquier caso, deber\u00e1 tenerse en cuenta un plazo de preaviso. Este \u00faltimo depender\u00e1 de la duraci\u00f3n del empleo y tambi\u00e9n de lo que estipule el contrato de trabajo o el convenio colectivo a este respecto. Si un empleado est\u00e1 enfermo, hay que tenerlo en cuenta. Al fin y al cabo, luego hay que ocuparse de la prohibici\u00f3n de despido.<\/p>\n<\/div><h1  class=\"h-custom-headline h5\" style=\"color: #006e78;margin-top:30px;  margin-bottom:0px;\"><span>\u00bfEn qu\u00e9 m\u00e1s deber\u00eda pensar?\u00a0<\/span><\/h1><div id=\"\" class=\"x-text\" style=\"margin-top:0px;\" ><p>Es posible que se haya acordado una cl\u00e1usula de no competencia y\/o no captaci\u00f3n al firmar el contrato de trabajo. \u00bfQuiere atenerse a ella? Entonces es importante incluir expl\u00edcitamente en el acuerdo de liquidaci\u00f3n que esta cl\u00e1usula sigue vigente. Si existen otras reclamaciones contra su empleado, como una deuda de estudios, tambi\u00e9n deben establecerse acuerdos al respecto. Tampoco est\u00e1 de m\u00e1s acordar qu\u00e9 bienes de la empresa a\u00fan deben entregarse.<\/p>\n<\/div><h1  class=\"h-custom-headline h5\" style=\"color: #006e78;margin-top:30px;  margin-bottom:0px;\"><span>Una buena preparaci\u00f3n es la mitad de la batalla<\/span><\/h1><div id=\"\" class=\"x-text\" style=\"margin-top:0px;\" ><p>El empleado tendr\u00e1 que estar convencido de que el acuerdo de conciliaci\u00f3n ofrece la mejor soluci\u00f3n para ambas partes. Tendr\u00e1 que iniciar la conversaci\u00f3n y dar al empleado la oportunidad de considerar su propuesta y pedir consejo. Por eso, suele ser buena idea dar al empleado una semana para decidir. Tambi\u00e9n puede ser prudente concederle tiempo libre durante ese periodo. A veces es inevitable tener que negociar algunas condiciones.
